Echoes Radio Artist Submission 

​Thank you for your interest in including your songs on our Echoes Radio platform. Please use the form below to submit up to five songs per artist or band. Every submission will be reviewed by a team member and you will receive notification of acceptance or denial with reasons in an email to the email address you provide.

 

Files uploaded should be professional, stream-ready mp3 files (at this time we can only accept MP3 uploads). Any uploads that do not meet quality standards will be denied.

 

Please note that submission does not guarantee inclusion and that we regrettably cannot include any songs from artists who do not read acknowledge and sign the terms and conditions listed below.

1. DIRECT BROADCAST LICENSE AGREEMENT VOLUNTARY RELEASE

 

This Direct Broadcast License Agreement ("Agreement") is entered into between the Artist (as indicated above including both legal name and stage moniker) and Broadcaster (Echoes Radio, Gentekk Solutions, LLC, Echoes In The Iron, LLC) . By signing, both parties agree to the following terms:

2. GRANT OF LICENSE

Artist grants Broadcaster a non-exclusive license to publicly perform and digitally transmit the Licensed Works via non-interactive internet broadcast (listeners cannot select tracks on demand). This license covers both the master sound recording and the underlying musical composition.

 

This is a direct voluntary license under 17 U.S.C. § 114. It supersedes the statutory license administered by SoundExchange and any blanket performance license administered by ASCAP, BMI, SESAC, or any other performing rights organization ("PRO") for the Licensed Works. Broadcaster owes no royalties to SoundExchange or any PRO for broadcasts of the Licensed Works under this Direct Artist Agreement.

 

 

(Optional Recommended Best Practice):  If any Licensed Work is registered with a PRO, Artist is encouraged to notify that PRO that the work is subject to a direct license with Broadcaster. This is not a condition of this Agreement. This direct license constitutes a complete grant of performance rights to Broadcaster and stands independently of any PRO registration or withdrawal

 

​​3. ARTIST OWNERSHIP WARRANTY

Artist represents and warrants that:

 

•  Artist is the sole owner of 100% of all rights in each Licensed Work, including the master recording and the musical composition;

•  No third party (including co-writers, co-owners, sample owners, or record labels) has any claim to royalties or rights that would conflict with this Agreement;

•  The Licensed Works contain no unauthorized samples or third-party material;

•  Artist has full authority to grant this license without any third party’s consent.

 

Artist’s breach of these warranties is the primary basis for any third-party liability and Artist agrees to be responsible for any resulting claims as set out in Section 5.

4. NO MONETIZATION

Broadcaster may display general advertising (including banner advertisements within the app or player interface) as part of its broadcast service. However, Broadcaster shall not: (a) sell advertising that is specifically tied to, triggered by, or presented as an endorsement of any individual Licensed Work or Artist; (b) charge listeners subscription or per-listen fees to access Licensed Works; or (c) accept payment from any third party in exchange for featuring or promoting a specific Licensed Work. General app-level or stream-level advertising that runs independently of which track is playing is expressly permitted.

5. INDEMNIFICATION & LIABILITY

Artist shall defend, indemnify, and hold Broadcaster harmless from any third-party claims (including PRO claims, co-ownership claims, and sample claims) arising from Artist’s breach of the warranties in Section 3. Broadcaster shall indemnify Artist from any claims arising from Broadcaster’s use of the Licensed Works outside the scope of this Agreement.

 

Neither party shall be liable for indirect, incidental, or consequential damages. Total liability of either party shall not exceed amounts paid under this Agreement in the prior 12 months.

 

6. TAKEDOWN & REMOVAL

Artist may request removal of any Licensed Work at any time by written or email notice to Broadcaster:

Broadcaster shall cease broadcasting the identified work within 72 hours of receipt. If a third party submits a rights claim regarding a Licensed Work, Broadcaster may suspend broadcast of that work pending resolution without liability to Artist.

 
7. TERM & TERMINATION
This Agreement runs for six (6) months from the Effective Date and does not renew automatically. If the parties wish to continue after the initial term, they must execute a new agreement or written extension signed by both parties. Either party may terminate for material breach with 30 days’ written notice and an opportunity to cure. Upon expiration or termination, Broadcaster shall immediately cease all broadcasts of Licensed Works.
8. REPORTING
Upon request Broadcaster shall provide Artist with a written play report on a quarterly basis showing the number of times each Licensed Work was broadcast. Reports shall be delivered via email within 30 days of each quarter’s end.
 
9. GENERAL
Ownership: This Agreement grants no ownership rights in the Licensed Works to Broadcaster. Artist retains full copyright.
No Assignment: Neither party may assign this Agreement without the other’s written consent.
Disputes: Disputes not resolved by good-faith negotiation within 30 days shall be submitted to binding arbitration under AAA Commercial Rules. The prevailing party may recover reasonable attorneys’ fees.
Entire Agreement: This document, including the Licensed Works table above, is the entire agreement between the parties on this subject and supersedes all prior discussions. Amendments must be in writing and signed by both parties.
Electronic Signatures: Electronic and PDF signatures are valid and binding.
